Data Controller: Keyame Media (Keyame Enterprises)
Website: www.keyame.co.ke

1. Introduction

This Privacy and Content Use Policy explains how Keyame Media (“we”, “our”, or “us”) collects, uses, stores, and protects personal data in the course of providing photography and videography services.

We are committed to handling personal data responsibly and in good faith, in line with the Kenya Data Protection Act and applicable international best practices.

While we make reasonable and continuous efforts to comply with evolving data protection standards, our processes reflect practical studio operations and may be updated from time to time.

2. Legal Basis for Processing

We process personal data under the following lawful bases:

  • Contractual Necessity – to deliver booked photography/videography services
  • Consent – for marketing, promotional use, and certain processing activities
  • Legitimate Interest – for business operations, internal record keeping, service improvement, and portfolio development

3. Personal Data We Collect

We may collect and process:

  • Identity & Contact Data: Name, phone number, email address
  • Transaction Data: Booking details, payment references (e.g., M-Pesa codes), billing records
  • Service Data: Session details, service type, photographer notes
  • Visual Data: Photographs and video footage captured during sessions

4. Purpose of Data Use

We use collected data to:

  • Deliver and manage photography/videography services
  • Process payments and maintain financial records
  • Communicate with clients (delivery updates, clarifications, support)
  • Improve our services and internal workflows
  • Showcase our work where consent has been provided

5. Image Use, Consent & Pricing Structure

Keyame Media operates a consent-based portfolio model:

  • Portfolio (Standard Rate):
Clients who grant permission allow us to use selected images for portfolio, social media, advertising, and promotional purposes.
  • Private (Executive Rate):
Clients who prefer full privacy may opt out of promotional use before or during booking. Adjusted pricing applies due to restricted usage rights.

Consent is collected at the point of booking or service intake and recorded for reference.

Withdrawal of Consent:
Clients may withdraw marketing consent at any time. Such withdrawal applies to future use and does not necessarily apply to materials already published or distributed.

6. AI-Assisted Editing & Processing

We use professional tools, including AI-assisted technologies, for editing, enhancement, and post-production.

  • We prioritize tools designed for professional processing, not public AI training
  • Client images are used strictly for creative production and delivery
  • By engaging our services, clients acknowledge this as part of the editing workflow

7. Data Storage, Retention & Archival (Best-Effort Policy)

We understand the long-term value of client memories and often retain files to assist with future retrieval requests.

However:

  • No Guaranteed Storage:
Long-term storage is provided on a best-effort basis only and is not a contractual obligation.
  • Retention Approach:
Data and media may be retained for operational, archival, or business purposes for an indefinite or flexible period, depending on internal needs and system capacity.
  • No Fixed Deletion Timelines:
We do not commit to automatic deletion after a specific duration.
  • Client Responsibility:
Clients are strongly advised to securely store their delivered files. We are not liable for loss of files once delivered.

8. Data Deletion & Client Requests

Clients have the right to request:

  • Access to their data
  • Correction of inaccurate data
  • Deletion of personal data

Request Handling:

  • Requests should be made via email or phone
  • We act on requests within a reasonable timeframe based on operational capacity
  • Where email communication is unsuccessful, clients are encouraged to follow up via phone
  • In some cases, verification may be required before processing requests

We make good faith efforts to honor all valid requests, subject to legal, contractual, or legitimate business requirements.

9. Data Sharing & Third Parties

We do not sell personal data.

We may share data with:

  • Service Providers: Cloud storage, editing tools, printing partners
  • Legal Authorities: Where required by law or lawful request
  • Technical Platforms: Secure systems that may process data outside Kenya

10. International Data Transfers

Some processing tools may store or process data on servers located outside Kenya.

Where this occurs, we take reasonable steps to ensure data is handled securely and in line with applicable standards.

11. Copyright & Ownership

  • Keyame Media retains creative ownership of all produced media
  • Clients receive personal usage rights for delivered content
  • Raw files remain the property of Keyame Media unless otherwise agreed in writing

12. Data Security

We implement reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or misuse.

However, no system is completely secure, and we cannot guarantee absolute security.

13. Limitation of Liability

To the extent permitted by law:

  • We are not liable for loss of data due to technical failures, storage limitations, or unforeseen circumstances
  • We are not responsible for client failure to back up delivered files
  • Our data handling practices are based on reasonable, good faith efforts, not absolute guarantees

14. Continuous Improvement & Compliance

Keyame Media is not a legal advisory firm, but we actively strive to align our operations with applicable data protection laws and evolving best practices.

Our policies and processes are continuously reviewed and improved. Any limitations reflect practical business operations rather than intentional non-compliance.

15. Your Rights

Under the Kenya Data Protection Act, you have the right to:

  • Access your personal data
  • Request correction or deletion
  • Object to certain processing
  • Withdraw consent at any time

You may also lodge a complaint with the Office of the Data Protection Commissioner.

16. Policy Updates

We may update this policy periodically. Continued engagement with our services constitutes acceptance of the updated policy.
